5.0 Comprehensive Terms for Financial Services
5.1 General Terms All applications are subject to the Company’s internal credit and risk assessments. Provision of Services is strictly conditional upon successful KYC completion.
5.2 Specific Terms for Investment Services
- Returns: Investment plans may offer an average annual interest rate of approximately 8%, subject to market conditions.
- Not a Bank Deposit: Investment plans are NOT bank deposits and are not insured by the DICGC.
- Withdrawal Protocol: A mandatory and non-negotiable three (3) month prior written notice is required for withdrawal before maturity.
- Early Withdrawal Penalties:
- Within 6 months: Interest rate reduced by 2.0% per annum.
- 6 to 12 months: Interest rate reduced by 1.0% per annum.
- After 12 months: Flat penalty of 0.5% on principal + adjusted interest.
5.3 Specific Terms for Lending Services By applying, you authorize Everest Finance to obtain your credit report from agencies like CIBIL. Specific loan terms (interest, EMI, penalties) will be detailed in a separate Loan Agreement.
6.0 Fees, Payments, and Taxation
6.1 Application Fee A non-refundable application and processing fee of ₹3,000 is applicable for all services. Refund of this fee is at the sole and absolute discretion of the Company if an application is rejected.
7.0 Disclaimers and Limitation of Liability
The information provided is for general purposes only and is not professional financial or tax advice. To the fullest extent permitted by law, Everest Finance shall not be liable for indirect or consequential damages. Our total cumulative liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
8.0 Governing Law and Dispute Resolution
- Governing Law: Laws of the Republic of India.
- Jurisdiction: Exclusive jurisdiction of the courts located in Bikaner, Rajasthan, India.
- Arbitration: Disputes not resolved amicably within 30 days shall be referred to binding arbitration in Bikaner, Rajasthan, under the Arbitration and Conciliation Act, 1996.
